These conditions are valid only between the company VISU s.r.l. Unipersonale, with registered office in Via Lega Lombarda, 10 - 24040 Bonate Sopra (BG) Italy, REA BG-425041, VAT No. 03980160166, hereinafter referred to as '' KITEWORLDSHOP '' and any person who purchases online at www.kiteworldshop.com hereinafter referred to as '' CLIENT ''. These conditions may be subject to change and the date of publication of the same on the site is equivalent to the date of entry into force

These conditions govern the purchases made on the site www.kiteworldshop.com, in accordance with the provisions of Part III, Title III, Chapter I, of the Consumer Code, Legislative Decree no. n. 206/2005, amended by Legislative Decree no. n. 21/2014 and by the Legislative Decree. 70/2003 on electronic commerce.

ARTICLE 1 - Object of the contract

With these general conditions of sale, KITEWORLDSHOP sells and the CUSTOMER remotely purchases the tangible movable goods indicated and offered for sale on the site www.kiteworldshop.com. The contract is concluded exclusively through the Internet, through the access of the CLIENT to the address www.kiteworldshop.com and the realization of a purchase order according to the procedure provided by the site itself.

The customer undertakes to examine, before proceeding with the confirmation of their order, these general conditions of sale, in particular the pre-contractual information provided by KITEWORLDSHOP and to accept them by affixing a flag in the indicated box.

In the e-mail confirming the order, the CLIENT will also receive a link to download and store a copy of these general conditions of sale, as provided for by art. 51 paragraph 1 of Legislative Decree 206/2005, amended by Legislative Decree 21/2014.

ARTICLE 2 - Pre-contractual information for the consumer - art. 49 of Legislative Decree 206/2005

Before the conclusion of the purchase contract, the CUSTOMER takes note of the characteristics of the goods that are illustrated in the individual product data sheets at the time of the choice by the CLIENT.

Before the conclusion of the purchase contract and before the validation of the order with "payment obligation", the CUSTOMER is informed about:

- total price of goods including taxes, with details of shipping costs and any other costs;

- terms of payment;

- the deadline by which KITEWORLDSHOP undertakes to deliver the goods;

- conditions, terms and procedures for exercising the right of withdrawal (Article 6 of the present conditions) as well as a withdrawal form as per Annex I, Part B of Legislative Decree 21/2014;

- information that the CUSTOMER will have to bear the cost of returning the goods in case of withdrawal;

- existence of the legal guarantee of conformity for the purchased goods;

- after-sales assistance conditions and commercial guarantees provided by KITEWORLDSHOP.

The CLIENT can at any time and in any case before the conclusion of the contract, take note of the information relating to KITEWORLDSHOP, the geographical address, telephone and fax number, e-mail address, information that is reported, also below:

ARTICLE 3 - Conclusion and effectiveness of the contract

The sales contract is considered concluded with the sending by KITEWORLDSHOP to the CUSTOMER of an e-mail confirming the order. The e-mail contains the data of the CUSTOMER and the order number, the price of the goods purchased, the shipping costs and the delivery address to which the goods will be sent and the link to print and store the copy of the present conditions.

The CUSTOMER undertakes to verify the correctness of the personal data contained therein and to promptly notify KITEWORLDSHOP of any corrections.

KITEWORLDSHOP undertakes to describe and present the items sold on the site in the best possible way. Nevertheless, some errors, inaccuracies or small differences between the site and the actual product may be highlighted. Furthermore, the photographs of the products presented on www.kiteworldshop.com do not constitute a contractual element, as they are only representative.

KITEWORLDSHOP undertakes to deliver the goods within 30 days of sending KITEWORLDSHOP an e-mail confirming the order to the CUSTOMER.

ARTICLE 4 - Availability of products

The availability of the products refers to the actual availability at the time the CUSTOMER places the order. This availability must however be considered purely indicative because, due to the simultaneous presence on the site of multiple users, the products could be sold to other CUSTOMERS before the order is confirmed.

Even after sending the order confirmation e-mail sent by KITEWORLDSHOP, there may be cases of partial or total unavailability of the goods. In this case, the order will be corrected automatically with the elimination of the unavailable product and the CUSTOMER will be informed immediately by e-mail.

If the CLIENT requests the cancellation of the order, by terminating the contract, KITEWORLDSHOP will reimburse the amount paid within 14 days from the day on which KITEWORLDSHOP had knowledge of the customer's decision to terminate the contract.

ARTICLE 5 - Methods of payment

Each payment by the CUSTOMER can be made only by credit cards indicated on the site www.kiteworldshop.com, by bank transfer, by Paypal payment method or by payment by installments from € 200.00.

In case of payment by credit card, the actual charge of the order amount will occur only when the order is complete and ready for shipment.

In case of payment with Paypal, the actual charge will be made when KITEWORLDSHOP sends the order confirmation e-mail.

Payments can also be made with the use of Loyalty Bonds.

The communications relating to the payment and the data communicated by the CUSTOMER when this is done, take place on special protected lines. The security of payment by credit card is guaranteed by VBV (Verified by VISA) and SCM (Security Code Mastercard) certification.

ARTICLE 6 - Prices

All sales prices of the products indicated on the site www.kiteworldshop.com are expressed in Euro and include VAT, and where applicable, of the Raee contribution.

Shipping costs are not included in the purchase price, but are indicated and calculated when the purchase process is completed before the payment is made.

The CUSTOMER accepts the right of KITEWORLDSHOP to change its prices at any time, however the goods will be invoiced on the basis of the prices indicated on the site when the order is created and indicated in the confirmation e-mail sent by KITEWORLDSHOP to the CUSTOMER.

In the event of an IT, manual, technical, or any other type of error that could result in a substantial change, not foreseen by KITEWORLDSHOP, of the retail price, which makes it exorbitant or clearly derisory, the purchase order will be considered invalid and canceled and the amount paid by the CUSTOMER will be reimbursed within 14 days. from the day of cancellation.

For customers ordering on Kiteworldshop from outside the EU (including UK from January 2021)

The prices do not includes any import taxes that the customers may have to pay.

ARTICLE 7 - Right of withdrawal

In accordance with the legal provisions in force, the CUSTOMER has the right to withdraw from the purchase without any penalty and without specifying the reason, within 14 days from the date of receipt of the products.

KITEWORLDSHOP decides to extend this term from 14 to 30 days, it will therefore be possible for the CUSTOMER to withdraw from the purchase contract up to 30 days. following the day of receipt of products purchased online. In the case of multiple purchases made by the CLIENT with a single order and delivered separately, the term of 30 days. starts from the date of receipt of the last product.

In the event of a request for termination of the contract received by KITEWORLDSHOP from the 15th to the 30th day from the date of receipt of the products by the CUSTOMER, the CLIENT will be entitled exclusively to the replacement with another product of equal or higher value, upon additional payment, or sending a voucher that can be spent within one year of issuing it.

The CLIENT who intends to exercise the right of withdrawal must communicate it to KITEWORLDSHOP through an explicit declaration, which can be sent by registered mail to.r. or by accessing the "My orders" section of the "My account" space at www.kiteworldshop.com, with the creation of a Return request.

The CUSTOMER may exercise the right of withdrawal also by sending any explicit declaration containing the decision to withdraw from the contract or alternatively transmit the standard withdrawal form, as per Annex I, part B, D.Lgs 21/2014 (not mandatory) whose text is shown below:

The direct costs of returning the products are charged to the CUSTOMER. The cost is estimated to be equal to a maximum of about 300.00 (three hundred / 00) euros.

The goods must be returned in the same conditions in which it was sent, intact, in the original packaging, with labels and tags intact and not removed from the article, complete in all its parts (including packaging and any documentation and accessory equipment: manuals , cables, etc.) and complete the annexed fiscal documentation. Without prejudice to the right to verify compliance with the foregoing, KITEWORLDSHOP will refund the amount of the products subject to withdrawal within a maximum period of 14 days, excluding any shipping costs.

As foreseen by the art. 56 paragraph 3 of Legislative Decree 206/2005, amended by Legislative Decree 21/2014, KITEWORLDSHOP may suspend reimbursement until receipt of goods.

KITEWORLDSHOP will reimburse using the same payment method chosen by the CUSTOMER at the time of purchase. In the case of payment made by bank transfer, and if the CLIENT intends to exercise his right of withdrawal, he will have to provide KITEWORLDSHOP, by accessing the contact section, the bank details: IBAN, SWIFT and BIC necessary for repayment, by KITEWORLDSHOP .

In case of withdrawal for the purchase made with gift card and loyalty voucher, the amount will be returned to the CUSTOMER with a purchase voucher identified with a promotional code that will be sent to the CUSTOMER's email address.

The purchase voucher will have validity of 1 years and can be used by the CUSTOMER for subsequent purchases in a single solution.

ATTENTION: The cases indicated in article 10 of these Terms and Conditions are excluded from the right of withdrawal.

ARTICLE 8 - Legal guarantee of conformity

Each product distributed by Kiteworldshop is covered by the Official Manufacturer Warranty in the terms set by Italian law and valid for products purchased and used within the territory of the European Community.

Starting from the product's date of delivery, the buyer is covered by a 24-month warranty period if he has purchased the product for personal purposes or 12 months if he has purchased for professional purposes (purchase with VAT number).

In the case of receipt of products that do not comply with the orders or defective, the CUSTOMER has the right to restore the conditions of the product by repairing or replacing the product. The CUSTOMER can exercise this right if the defect occurs within two years from the delivery of the goods and with notification of the defect to KITEWORLDSHOP within two months from the discovery of it.

Subsequently, the customer will have to proceed to the creation of an on line return request by accessing the "My orders" section in the "My account" space at www.kiteworldshop.com.

KITEWORLDSHOP, in case of defective or non-compliant product, will arrange, at its own expense, the collection of the product, compatibly with the availability of the CUSTOMER.

The warranty never covers the damage caused by improper use of the products and any damage caused by the same products to third parties or to things and objects owned by third parties.

ARTICLE 9 - Commercial guarantee

All products presented on the site www.kiteworldshop.com benefit, as well as the legal guarantee of conformity referred to in the previous article, a commercial guarantee whose duration is quoted on the product sheets of the articles.

To use the warranty, the CUSTOMER must keep the receipt that can be printed by accessing the "My orders" section of the "My account" space.

ARTICLE 10 - Delivery methods

The products will be delivered by express courier to the address indicated by the CUSTOMER at the time of order no later than 30 days. from the date of receipt by the CLIENT of the order confirmation e-mail sent by KITEWORLDSHOP.

For every order placed on the site kiteworldshop.com, KITEWORLDSHOP will issue a Payment receipt for the goods shipped. The Payment receipt is available and printable, after the order has been completed, in the "My orders" section of the "My account" space of the CUSTOMER. The Payment receipt will contain the information provided by the CUSTOMER during the purchase process. After the Payment receipt has been issued, it will not be possible to make any changes to the data indicated in the same.

KITEWORLDSHOP does not issue invoices, if a customer wants to receive a tax invoice for his company, he must send an explicit request at the moment of order using the order's notes area or by e-mail within 24 hours.

If you place your order as a company and dispose of international VAT number, we happily subtract VAT from your invoice. We kindly ask you to first place your order and once you have received your order number, please contact us immediately to provide us with the VAT number of your company and a copy of the company ID card. The VAT will be removed from your invoice and you will receive a refund of the difference by the same payment method you used when placing the order.

Pick Up ponts

For our customers it is possible to collect products at one of the Kiteworldshop's Pick-up points on request, after the order the products will be sent to the chosen pick up point and customers will be notified of the availability of the products for collection.

It is up to the customers to collect the goods within 10 days of the notification of the availability of the products for collection.

ATTENTION: In the case of Pick-up requests for rigid SUP boards at one of the Kiteworldshop's Pick-up points, from the moment of the order it will no longer be possible for customers to withdraw from their purchase, the product will immediately become their property and they will have to take care of the withdrawal within 5 days of notification of availability at the Pick UP point of their choice.

Article 7 of our Terms and Conditions does not apply to these specific cases, so there are no refunds or cancellations.

For customers ordering on Kiteworldshop from outside the EU (including UK from January 2021)

We would highly recommend that you check your national import policy. It is essential that you evaluate a budget for any import taxes that you may have to pay. Kiteworldshop is not responsible for these charges and if they are due you will be contacted by your customs office.

If Kiteworldshop sends an item out of Europe and it is then rejected by the customer due to the import charges, the customer will receive the full refund for the items when it is returned to our warehouse minus the total shipping and returns costs.

ARTICLE 11 - Responsibility

KITEWORLDSHOP assumes no responsibility for disservices due to force majeure or unforeseeable circumstances, even if they are dependent on malfunctions and disruptions of the Internet, if it fails to execute the order within the time stipulated in the contract.

ARTICLE 12 - Access to the site

The CLIENT has the right to access the site for consultation and purchase. No other use, in particular commercial, of the site or its contents is permitted. The integrity of the elements of this site, whether audio or visual, and the relative technology used remain the property of KITEWORLDSHOP and are protected by the intellectual property right.

ARTICLE 13 – Cookies

The website www.kiteworldshop.com uses "cookies". Cookies are electronic files that record information relating to the navigation of the CLIENT on the site (pages consulted, date and time of the consultation, etc. ..) and that allow KITEWORLDSHOP to offer a personalized service to its customers.

KITEWORLDSHOP informs the Customer of the possibility to disable the creation of these files by accessing its Internet configuration menu. It is understood that this will prevent the Customer from proceeding with the online purchase.

ARTICLE 14 - Integrality

These General Conditions of Sale are constituted by the totality of the clauses that compose them. If one or more provisions of these General Terms and Conditions of Sale is considered invalid or declared as such under the law, regulation or following a decision by a court having jurisdiction, the other provisions will continue to have full force and effect.

ARTICLE 15 - Applicable law and competent court

These General Conditions of Sale are subject to Italian law.

Any dispute that does not find a friendly solution will be submitted to the exclusive jurisdiction of the Court of the place of residence or domicile of the CUSTOMER, if located in the territory of the State.

In any case, it is possible to optionally resort to the procedures of mediation pursuant to Legislative Decree 28/2010, for the resolution of any disputes arising in the interpretation and execution of these conditions of sale.
